2. Definitions

For the purpose of these Terms:

  • Services refers to messaging solutions, WhatsApp API integration, RCS messaging, automation tools, and communication services offered by the Company.
  • User / Client / Customer refers to any business, individual, or organization using the services.
  • Platform refers to messaging platforms including WhatsApp, RCS, SMS gateways, or other communication services.
  • Content refers to messages, media, text, files, data, or information transmitted through the services.
  • Account refers to the registered account created by a user to access the services.

3. Acceptance of Terms

By using the services provided by RiseUp Infodesk, you confirm that:

  • You have read and understood these Terms.
  • You agree to comply with all applicable laws and regulations in India.
  • You agree to comply with messaging platform policies including Meta Business Messaging Policies and RCS standards.

These Terms apply to all visitors, users, customers, and others who access or use the services.


4. Description of Services

RiseUp Infodesk provides the following services:

  • WhatsApp Official Business API integration
  • Rich Communication Services (RCS) messaging solutions
  • Messaging automation systems
  • Customer communication tools

8. Payment & Billing Terms

Certain services offered by RiseUp Infodesk may require payment.

Payment terms include:

  • All fees are non-refundable unless stated otherwise
  • Taxes applicable under Indian law may apply

Failure to make timely payments may result in service suspension.


9. Subscription Renewal & Termination

Users may terminate services by providing written notice to the Company.

RiseUp Infodesk reserves the right to terminate accounts if:

  • Payments remain unpaid

Services provided by RiseUp Infodesk may include integration with messaging platforms such as:

  • RCS messaging platforms
  • Telecom operator messaging systems

Users must comply with:

  • Meta Business Messaging Policies
  • WhatsApp Commerce Policy
  • Telecom regulatory guidelines
  • Data protection regulations

The Company does not control these third-party platforms and cannot guarantee uninterrupted availability.


11. Message Delivery & Compliance Policy

While RiseUp Infodesk provides messaging infrastructure, message delivery depends on several factors including:

  • Recipient network availability
  • Telecom operator filtering
  • Platform policies
  • User device availability

The Company does not guarantee 100% message delivery.

Users are solely responsible for ensuring that their messaging campaigns comply with:

  • Meta policies
  • TRAI regulations
  • Anti-spam laws
  • Privacy regulations

12. Intellectual Property Rights

All intellectual property associated with the services including:

  • Software
  • Branding
  • Website content
  • Documentation
  • System architecture

remain the exclusive property of RiseUp Infodesk.

Users may not:

  • Modify
  • Distribute
  • Reverse engineer
  • Resell the platform

without written permission.


13. Confidentiality

Both parties agree to maintain confidentiality of sensitive business information including:

  • Technical infrastructure
  • Customer data
  • Pricing agreements
  • Internal business processes

Confidential information must not be disclosed without written consent unless required by law.


14. Disclaimer of Warranties

Services are provided “as is” and “as available.”

RiseUp Infodesk does not guarantee:

  • Uninterrupted service
  • Error-free performance
  • Message delivery success
  • Platform availability

Third-party platforms such as WhatsApp and telecom networks may affect service availability.


15. Limitation of Liability

To the maximum extent permitted by Indian law:

RiseUp Infodesk shall not be liable for:

  • Indirect or consequential damages
  • Loss of profits
  • Loss of business data
  • Messaging campaign failures
  • Platform restrictions imposed by third parties

Total liability shall not exceed the amount paid by the customer for services in the preceding billing period.


16. Indemnification

Users agree to indemnify and hold harmless RiseUp Infodesk, its employees, partners, and affiliates from any claims, liabilities, damages, or expenses arising from:

  • Misuse of the services
  • Violation of these Terms
  • Violation of platform policies
  • Violation of applicable laws

17. Governing Law (India)

These Terms shall be governed and interpreted in accordance with the laws of India.

Any disputes arising from these Terms shall be subject to the jurisdiction of the courts located in Nashik, Maharashtra, India.


18. Changes to Terms

RiseUp Infodesk reserves the right to modify these Terms at any time.

Updated Terms will be published on the official website.

Continued use of services after updates constitutes acceptance of the revised Terms.
